Pursuant to 23 U.S.C. 327 and a Memorandum of Understanding (MOU) between the Federal Highway Administration (FHWA) and the Ohio Department of Transportation (ODOT) executed December 11, 2015 and amended June 6, 2018, ODOT has assumed all the U.S. Department of Transportation Secretary’s responsibilities for compliance with NEPA and other Federal environmental laws for highway projects within the State of Ohio subject to the terms and conditions set forth in 23 U.S.C. and the MOU. These responsibilities include the environmental review, reevaluation, consultation, and other actions pertaining to the review or approval of highway projects required by applicable federal environmental laws. Since ODOT was granted this responsibility by FHWA, ODOT now acts as the federal agency for environmental compliance.
