 DBE Program Overview


Name of Program: Disadvantaged Business Enterprise (DBE) as set forth in 49 CFR part 26, the DBE Final Rule.

Brief Program Description: The purpose of this program is to remedy past and current discrimination against DBEs, to ensure a level playing field, foster equal opportunity in DOT-assisted contracts, improve the flexibility and efficiency of the DBE Program, and reduce burdens on small businesses. Who Must Comply? All Federally funded grantees. This includes recipients of FTA operating, planning or capital funds. Requirements include establishing a DBE goal for all contracting opportunities, excluding vehicle purchases, and reporting past results.

Program Requirements: Grantees anticipating procurements of more than $250,000 in federal funds (threshold recipients) must also establish and follow a DBE Program.

This program can include contract specific goals, in addition to an annual goal. Threshold Grantees must also submit semi-annual progress reports to FTA/ODOT.

Program Deadlines/Due Dates: The Office of Transit's Section 5311 sub-grantees must submit semi-annual progress reports to ODOT on October 31 and April 30. If significant changes have been made to the individual grantees' DBE Programs, during any given year, their DBE Programs must then be updated and submitted to ODOT for submittal to FTA by July 15.
