Pursuant to Chapter 5501.34 of the Ohio Revised Code, I will offer by  public auction the following tracts of excess land located in Licking County on Thursday, January 31, 2019 at 1:00 p.m., at the property site located at 2135 West Main Street, Newark, Ohio  43055


Parcels to be offered for sale:

The subject contains 11.949 gross/net acres and is identified as a portion of Auditor Parcel Number 054-217608-07.000.  Also known by ODOT as part of parcel number 64 WL. Located on the south side of West Main Street east of Thornwood Drive, in the State of Ohio, County of Licking, City of Newark, Quarter 4, Range 12 West, Township 2 North, United States Military Lands.  The parcel has an Appraised Value of $203,130.00. The minimum opening bid and minimum acceptable bid has been established as Two-Thirds (2/3) appraised value at $135,420.  A Security Deposit of Twenty Thousand Dollars ($20,000.00) (cashier's check or money order) is Required at the time of  Bid.  Grantor hereby reserves unto itself, its successors and assigns, any and all of the oil and gas and their constituents, sulfur, coal, lignite, uranium, and other fissionable material, geothermal energy, base and precious metals, rock, stone, gravel, and any other mineral substances presently in or under the premises described in Exhibit A.

ADDITIONAL TERMS OF SALE: Security deposit must be made in the form of a cashier’s check or money order at the time of successful bid.  Make remittance payable to: “Treasurer, State of Ohio”.  The security deposit will be applied against the full purchase price of the property.  The balance of the purchase price is due and payable on delivery of the Governor’s Deed.  It is anticipated the Governor’s Deed will be available for delivery to the Grantee within 70 to 90  days from the date of the sale or as soon thereafter as possible.


Under no circumstance may the individual, firm, or corporation who has been declared the successful bidder advertise the property for sale to a third party until the Governor’s Deed has been delivered to the Grantee.  Violation of this requirement may, at the option of the Grantor, result in the forfeiture of the deposit money and cancellation of the sale.


The Contract of Purchase executed by the Grantee(s) and agents of the Grantor (State of Ohio) on the date of sale, is not binding upon the Grantor until said Contract of Purchase has been approved by an official of the Ohio Department of Transportation, in Columbus, Ohio.


The Ohio Department of Transportation reserves the right to reject any and all bids on any tract listed for sale.  A Non-Collusion Affidavit, Form RE 73-02, must be properly executed by the successful bidder for a bid to be considered valid.


ODOT property is offered for sale in “as is” condition.   It shall be the responsibility of each bidder to inspect and examine the size and condition of each parcel.  The descriptions listed are to be used for identification purposes only and are not to be construed as a warranty of any kind.
