Planting vegetation within ODOT’s right of way is permissible. However, certain criteria must be met prior to receiving approval. Listed below are steps that must be taken to receive this authorization from ODOT.
Ø Specific and detailed scope of work and location
Ø Check off “Beautification” on page 1, item 2 and complete page 2
Ø Any vegetative planting must be in compliance with right of way visibility standards, clearance restrictions and other safety guidelines.
Ø Vegetation Removal: If vegetation is required to be removed in a particular planting area of interest a Certified Arborist Report may be required. This will provide information regarding any monetary value associated with the vegetation needing to be removed. If removal is required, payment to the Treasury of the State of Ohio may be necessary. Please contact a certified arborist in your local area for a tree assessment.
v Plan Submission includes:
Ø A plan view of the vegetative removal limits and proposed landscaping.
Ø Landscape plantings are required to be Ohio native species. This FHWA Page provides information regarding permissible Ohio native species.
Ø Illustrate how the planting will not obstruct motorist site distance.
v Maintenance Agreement includes:
Ø Permit holder is responsible for maintaining all proposed landscaping in the right of way and not ODOT.
v Permit Review Period:
Ø ODOT District 8 Permit Department will review the application within 30 days, from the date it was received.
